Employment Contracts

When you employ people in your business, they need to know what you expect from them & what they can expect from you.


Having an employment contract between an employer and employee sets out all of those expectations.


You can’t have an employment contract that provides an employee less than the legal minimum set out in the National Employment Standards (NES), awards, enterprise agreements or other registered agreements that may apply to your employees.


A contract can’t make employees worse off than their minimum legal entitlements.


You can’t force someone to sign or agree to a contract so it’s a really good idea to make sure the contract is signed before your employee starts work with you.

A verbal agreement can also be legally binding, but the terms of the verbal contract are often a lot harder to prove without written evidence.


Signing the contract

You should provide the employee with a duplicate copy of the contract to sign, date, & return.


If you’re sending the contract by email or electronically, it’s recommended that you send it in PDF form and make sure you follow up to ensure your employee signs the contract and returns a signed copy to you for your records.


You could send the employment contract through an electronic document signing software or an HR system.

EMPLOYMENT CONTRACT (COMPREHENSIVE) - PERMANENT EMPLOYEE

This comprehensive contract is suitable for full-time and part-time employees. It’s not intended to apply to casual employees or independent contractors.


iIt's approximately 12-23 pages in length (depending on the required inclusions).





EMPLOYMENT CONTRACT (SIMPLE) - PERMANENT EMPLOYEE

If you would prefer something shorter for your full time or part time employees, you can use the ‘simple’ contract of employment which is shorter.


This isn't a comprehensive legal document & won't give the same cover as a comprehensive contract.


This contract is not intended to override award/agreement obligations. It’s not intended to apply to casual employees or independent contractors.


EMPLOYMENT CONTRACT APPRENTICE/TRAINEE

This short employment contract is suitable for apprentices and trainees and it covers:


• the employee’s position;

• probation;

• general obligations;

• salary;

• commencement date;

• hours of work;

• superannuation;

• leave;

• policies and procedures;

• vaccinations;

• IT, computers and devices and surveillance;

• termination of employment and what happens if the employee does not comply with their Training Contract;

• general matters



EMPLOYMENT CONTRACT (COMPREHENSIVE) - CASUAL EMPLOYEE

$550


This comprehensive contract is approximately 10 pages in length.

The drafting of this contract will help minimise the risk your business may be exposed to for back payment from both current and former employees who may have been engaged on a casual basis but worked on a long-term, regular or predictable basis.


EMPLOYMENT CONTRACT (SIMPLE) - CASUAL EMPLOYEE

If you would prefer something shorter for your casual employees, you can use the ‘simple’ contract of employment which is only 5 pages in length.
